Mediation Day

An exciting new opportunity to settle "smaller" personal injury cases

While it is generally accepted that mediation is an effective way to achieve fair settlement of personal injury cases, many "small cases" are not mediated because of the perceived high relative cost of mediation with effective, experienced mediators.

In order to provide the community with a cost-effective forum for the mediation of smaller personal injury claims, Judge Gilbert has joined with prominent Sacramento based mediators Buzz Wiesenfeld and Ernie Long to offer "Resolution Arts Mediation Day".

What you need to know about Resolution Arts Mediation Day:

  • What cases are eligible?
    • Personal injury cases with no more than 3 parties and no demand over $100,000.
  • What about "pre-litigation cases?
    • Absolutely welcome.
  • Do all parties have to be represented?
    • Not necessarily. We prefer Plaintiffs to be represented by counsel, but will consider "pro per" cases. Please ask. Insurance carriers can have claims personnel handle the entire process.
  • Are "mediation briefs" required?
    • No. In fact, instead of briefs, we provide a short "Case Questionnaire" to be filled out by each party to provide the mediator and the parties with concise, focused, common information to "kick start" the discussions.
  • Who will be the mediator?
    • The assignment to Buzz Wiesenfeld, Rick Gilbert or Ernie Long will be by rotation. That way you get a great mediator and we spread the work load evenly.
  • What is the Mediation Day schedule?
    • Up to three cases will be scheduled for 4 time slots, 9:00 am, 11:00 am, 2:00 pm and 4:00 pm. Times are scheduled on a first come first served, basis. Our goal is to complete each case in its scheduled time slot. We anticipate hard work and focused discussions. We won't give up, however, so be prepared to "double track" if more time is needed.
  • What is the cost?
    • $600.00 per case, total. That cost can be shared however you agree or one side can pay all. The fees are payable in advance.
  • Where are Mediation Day sessions held?

  • All mediations are at the Resolution Arts Building. Location and parking information is on this site.
  • How can I "get the ball rolling"?
    • Contact opposing counsel and suggest participating. Send a link to this website. Consider sending a letter inviting participation in "Mediation day."
